"There is a ticking clock, according to [Perry's] attorney Drescher. Due to current zoning regulations, he said, if the business is closed longer than 30 days, 'they lose their permit to operate the cafe,' he told The Mountain Enterprise."
The Mountain Daily News asked Drescher about this and was told that this point was actually made by attorney Jack LaPedis. "I really don't know anything about it" said Drescher.
When asked about this, Calloway's attorney states: "My only on the record response at this time is as follows (since, as I previously mentioned, we are still gathering documentation regarding this matter): It is the intention of my clients to make every effort to have the Dream Castle Cafe re-open, in one form or another, as soon as possible."

I just got off the phone with Jack LaPedis, attorney for Glen Calloway. LaPedis says that his client denies the allegations made by Carolyn Perry. "The allegations were made while my client was out of state. He just returned to California last night to deal with the claims made by Ms. Perry in his absence." Glen Calloway and his attorney are currently gathering documentation for his defense.
UPDATE - 9/16/2009, 11:27 AM
I just got the following from owner Carolyn Perry:
This was my future. It saddens me to have to close such an intricate part of the community. I experienced first hand how the Dream Castle brought people together, not tear them apart as in this case.
It was my understanding, as well, that the doors were going to close August 15th regardless of a sale, then I came along.
I have retained my attorney to right the wrongs.
According to attorney Robert Drescher, Carolyn Perry purchased the Dream Castle business from Glen Calloway but had to close the doors due to substantial misrepresentation on Calloway's part. Perry was told the business owed no money but found otherwise when she acquired it.
"The potential liability made the business unsustainable and impossible for the new owner to continue" said Drescher "Carolyn is broken up over the close of the business because she knows how much The Dream Castle means to Frazier Park."
Perry's attorney is seeking to recover her losses and is entering a second phase with Calloway and his attorney.
