UPDATE 2/27 3:45 PM
An email asking for Glenn Calloway's side of the story was sent to his attorney. The Mountain Daily News will publish when a statement is received.
Carolyn Perry bought The Dream Castle from Glenn Calloway and says she got into a big mess. Calloway sued Perry but neither Calloway or his attorney appeared in court on the scheduled date according to County records. Here is Perry's side of the story, unedited.
Needless to say, I am just beside myself. The news that Glenn Calloway and Lorraine Ridley have filed for bankruptcy this morning has hit hard. This was their intended threat to me during mediation after they played the ‘poor card‘ and after trying to work out a monthly payment to just pay back what they had taken from me. “Well, we’ll just file for bankruptcy!“ This is what was said in mediation. My biggest mistake was trusting this couple and not having an attorney look over my contract BEFORE I signed. He found nine counts of fraud after the fact. A hard lesson learned. It was overheard at the opening/closing party that Lorraine told a close friend, “We need to get out of here now, before the s**t hits the fan” . Now I understand the validity of that comment. Not only did they intend to burn me, but they burned Mary Leis as well, not to mention the $100,000 outstanding debt (lien) with Wells Fargo for the property they said THEY owned outright. ‘No third party debt or liens’ were promised to me both verbally and contractually, little did I know.
There have been rumors that, I, “ran the place into the ground” … or that I am “sue-happy”. Why would I invest so much money into my future only to sabotage it by my own doing?? Only to be left jobless with no security. ‘Sue-happy’ I believe only applies when you are a habitual court going individual out to SCAM people for money and have no conscious or weight to support a valid case. Nine counts of fraud is a valid case and I ONLY asked for what they took, no MORE, but was even willing to settle for less to accommodate their monthly income!!
The retired judge (of 30+ years in criminal law) who handled our mediation simply told me behind closed doors after he had met them and heard ‘their side’, .. “They are crooks, plain and simple. I do not believe a word of what they are saying, you have a strong case for court and should have no problem winning your case”. Then Glenn and Lorraine put a crowbar on the front door to the café and vanished, nowhere to be found, nowhere to be SERVED! Not even their own attorney would respond to my attorney’s communications. A few weeks passed and they got a different attorney and they decided to sue me for over $100,000. My attorney took the gloves off and said, “Great, NOW we know where they are and can serve them in court with (technically) a counter-suit for the original complaint filed. No problem, Carolyn, just sit tight.”
They never showed up for court and filed for bankruptcy within the week.
I have been in this community for 10 years. It has had its bumps with a few individuals that I may not have seen eye-to-eye with, but that is life, anywhere in the world. This just happens to be a small community where everyone knows everyone and their business and, yes, everyone has an opinion. I have not had an easy life, but as I’ve gotten older I’ve realized that it is time to buckle down and get serious with my future, find my way and make this mountain my home. I believed in the café, I believed wholeheartedly that I could contribute something wonderful to this community that I have come to love and with the plans that I had and the commitment I had made.
I hope that the DreamCastle does not fade away as with so many other foreclosures.
Thank you to those who have supported me and believed in me.
Carolyn Perry
